Carolina Bracken’s client cleared of wrongdoing in NMC
Carolina Bracken represented a nurse accused by the NMC of having intentionally viewed and downloaded indecent images of children. The images were found in an accessible folder on his personal computer during a police investigation.
During the hearing, the NMC sought to amend the charges to address evidential difficulties, which had been laid bare by Carolina’s cross-examination of the digital analyst and her legal arguments. Carolina successfully opposed every such application, keeping the scope of the allegations focused and consistent. The Panel ultimately agreed with Carolina’s submissions that there was insufficient evidence that 1) the Registrant had intentionally viewed or downloaded the images, and 2) they were indecent images of children (contrary to the analyst’s conclusion). The Panel found none of the alleged charges proved. Carolina’s client continues their unblemished nursing career.
