Carolina Bracken wins abuse of process argument

Carolina Bracken successfully argued that the prosecution against the defendants she represented was an abuse of process.

Carolina’s clients had been employed as managers by a London Borough on the City Farm owned by the Borough. The Borough prosecuted their former employees for numerous offences relating to the welfare of the farm’s animals and the maintenance of the farm.

Carolina successfully argued that the prosecution was an abuse of the court process. She argued that the prosecution should never have been brought as the Borough was potentially criminally liable for the offences brought against the defendants. She submitted that the prosecution was biased, politically motivated, and that her clients had been scapegoated.

The Judge stayed the proceedings as an abuse of process, finding: “There is evidence of bias, lack of independence, and it would be an affront to justice to continue this prosecution.”
