Ben Douglas-Jones QC Appears in Leading Trafficking Case

Ben Douglas-Jones QC (leading Daniel Bunting) appeared for the Crown before the Lord Chief Justice, Edis and Johnson JJ in the leading case of R v DS [2020] EWCA Crim 285.

The Court held that (1) abuse of process was abolished as a remedy in cases where victims of trafficking are prosecuted for offences following the statutory defence in the Modern Slavery Act 2015 coming into force; and (2) it was held that the CPS is entitled to make a different decision as to the status of a possible victim of trafficking from the Single Competent Authority.
